1. Who we are

1.1

These Subscription Terms & Conditions apply to subscription boxes supplied by:

1.2

In these terms:

  • “we”, “us” and “our” mean Inclusive Stories Ltd.
  • “you” and “your” mean the person purchasing the subscription.
  • “box” means an Inclusive Stories subscription box.
  • “subscription” means a recurring Inclusive Stories Box subscription purchased from us.
  • “billing period” means the monthly period to which each recurring payment relates.
1.3

You must be aged 18 or over and legally able to enter into a binding contract to purchase a subscription. You may purchase a subscription for a child or another person, but the contract is with the adult who places the order.

2. About Inclusive Stories Box subscriptions

2.1

Inclusive Stories Box subscriptions provide recurring deliveries of inclusive books, sensory items, activities and/or other resources, depending on the subscription selected.

2.2

The age range, typical contents, price and characteristics of each subscription will be displayed on the relevant product page before you subscribe.

2.3

Contents may vary between boxes. Where necessary, an item may be substituted with another suitable item of reasonably equivalent value or purpose. Where a material substitution affects your order, we will provide information about the change where appropriate.

2.4

These terms apply specifically to Inclusive Stories Box subscriptions. Individual books, sensory products, apparel, downloadable resources and other one-off purchases may be subject to our separate general sales terms.

2.5

Digital subscriptions, including the SEND Resource Vault where offered, are governed by separate digital subscription terms.

3. Choosing your subscription

3.1

Depending on availability, you may be offered:

  • a 3-Box Subscription;
  • a 6-Box Subscription;
  • a 12-Box Subscription; or
  • a Monthly Rolling Subscription.
3.2

The 3, 6 and 12-box options describe your selected subscription and loyalty-reward journey. They are not minimum payment commitments.

3.3

You pay monthly. You are not charged the entire cost of a 3, 6 or 12-box journey upfront unless a separate product or offer expressly states otherwise. Each successful monthly payment relates to one monthly box.

3.4

You may cancel your subscription in accordance with section 8. If you cancel before completing your selected 3, 6 or 12-box journey:

  • you will not owe payment for future boxes after cancellation takes effect;
  • there is no early termination charge;
  • you will not be required to pay for the remaining months in your selected journey; and
  • you will not qualify for a loyalty reward that has not yet been earned.
3.5

After completing your selected 3, 6 or 12-box journey, your subscription will automatically continue as a monthly rolling subscription unless you cancel. Completing a 3, 6 or 12-box journey does not automatically start another 3, 6 or 12-box journey.

3.6

The fact that the subscription continues monthly after your selected journey will be clearly explained before you subscribe.

3.7

Where a Monthly Rolling Subscription is offered, it will continue monthly until cancelled in accordance with these terms.

4. Information provided before you subscribe

4.1

Before you subscribe, we will provide important information about your subscription, including:

  • the subscription selected;
  • the main characteristics of the box;
  • the applicable age range;
  • the monthly price;
  • any delivery charge;
  • the total recurring monthly payment;
  • when the first payment will be collected;
  • how subsequent payments will be collected;
  • expected dispatch and delivery arrangements;
  • how to cancel;
  • whether the subscription continues after the selected journey;
  • any applicable loyalty reward and the conditions for earning it;
  • our contact information; and
  • information about applicable statutory cancellation rights.
4.2

The checkout will clearly identify that you are purchasing a recurring subscription.

4.3

Before completing payment, you will be shown a summary of the recurring payment obligation.

4.4

The checkout will clearly communicate that completing the subscription order creates an obligation to pay.

4.5

We will provide confirmation of your subscription and relevant contractual information by email or another durable medium after your subscription has been accepted.

5. Prices and monthly payments

5.1

The monthly price of your subscription will be displayed before you place your order.

5.2

Your first payment will normally be collected when you subscribe.

5.3

Subsequent payments will be collected automatically each month using the payment method authorised when you subscribe.

5.4

Stripe processes our online subscription payments. By subscribing, you authorise us and our payment provider to collect recurring monthly payments from your authorised payment method while your subscription remains active.

5.5

You do not need to manually make each monthly payment.

5.6

Each successful recurring payment relates to one monthly subscription box.

5.7

Before you complete your purchase, checkout will clearly display:

  • the monthly subscription price;
  • any applicable delivery charge;
  • any applicable discount;
  • any applicable free-delivery entitlement; and
  • the total recurring monthly amount payable.
5.8

Inclusive Stories Ltd is not currently VAT registered. VAT is therefore not separately added to your order by Inclusive Stories Ltd.

5.9

If our VAT status changes, we will update our pricing information and these terms as necessary.

6. Delivery

6.1

We currently deliver subscription boxes to eligible UK addresses. Any geographical restrictions or exclusions will be displayed before purchase.

6.2

Standard UK delivery costs £3.99 per shipment.

6.3

Free UK standard delivery applies where the eligible physical order value reaches £40. The treatment of discounts, promotional codes and other reductions when calculating the £40 threshold will be displayed as part of the applicable offer or checkout.

6.4

We aim to dispatch your subscription box within 2 working days after the relevant payment has been successfully collected.

6.5

Standard UK delivery is normally estimated at 3–5 working days after dispatch.

6.6

The dispatch and delivery periods stated above are estimates unless a specific delivery deadline has been expressly agreed with you.

6.7

If your delivery is delayed, we will take reasonable steps to investigate and resolve the issue. Your statutory rights relating to delivery remain unaffected.

6.8

Goods generally remain at our risk until they come into your physical possession or the physical possession of a person you have identified to receive them, subject to applicable consumer law.

6.9

If tracking shows that your parcel has been delivered but you cannot locate it, please contact us promptly at:

We will take reasonable steps to investigate the delivery with the relevant delivery provider.

6.10

Nothing in this section limits your statutory rights.

7. Loyalty gifts and rewards

7.1

Some subscription journeys include a loyalty gift or reward.

7.2

A loyalty reward is earned only after you have completed the required number of successfully paid monthly boxes.

7.3

A box counts towards your loyalty journey only where:

  • payment has been successfully collected; and
  • the corresponding box is supplied.

A failed, reversed, refunded or unpaid payment does not count towards the reward unless the payment is subsequently completed and the corresponding box is supplied.

7.4

The current loyalty structure is:

  • 3-Box Subscription: No loyalty gift currently included.
  • 6-Box Subscription: A T-shirt is earned after six successfully paid boxes and included with the sixth box.
  • 12-Box Subscription: A Neuro Inclusive Squad Bag and T-shirt are earned after twelve successfully paid boxes and included with the twelfth box.

The exact 6 and 12-box rewards must be confirmed before publication.

7.5

A loyalty reward is not earned merely by selecting a 6 or 12-box subscription. It is earned only after the required number of successfully paid boxes has been completed.

7.6

If you cancel before completing the required number of boxes:

  • you will not receive the scheduled reward;
  • you will not be charged for the reward;
  • there is no early termination charge; and
  • you will not be required to continue paying merely to qualify for the reward.
7.7

If you have legitimately earned and received a loyalty reward, you will not be required to return it merely because you subsequently cancel your subscription.

7.8

Rewards are subject to reasonable availability. If an advertised reward becomes unavailable, we may offer a reasonably equivalent replacement. Where appropriate, we will inform you of a material substitution.

7.9

Unless the relevant offer states otherwise, loyalty rewards:

  • cannot be exchanged for cash;
  • are not transferable; and
  • may be subject to available sizes, colours or designs.
7.10

If you cancel and later start a new subscription, your loyalty count will normally start again. Previous boxes will not automatically carry over to the new subscription unless an offer expressly states otherwise.

8. Cancelling your subscription

8.1

You may request cancellation of your subscription at any time. You can cancel:

8.2

If you cancel before your next monthly recurring payment has been collected, cancellation will take effect before that next renewal. No further subscription payment will be collected and no further box will be supplied.

8.3

If your next monthly payment has already been successfully collected before your ordinary subscription cancellation takes effect, your cancellation will normally take effect at the end of that paid billing period. You will receive the box covered by that successful payment, subject to your separate statutory cancellation and consumer rights.

8.4

We will confirm your cancellation and, where the facility is available, your customer account will show when the subscription is due to end.

8.5

Cancelling before completing a 3, 6 or 12-box journey does not make the remaining payments due. There is:

  • no early termination fee;
  • no compensation charge; and
  • no liability for boxes that would otherwise have been supplied in future billing periods.
8.6

If cancellation takes effect before the payment that would have completed a loyalty journey, the associated reward will not be earned. If the relevant payment has already been successfully collected and the corresponding box completes the loyalty journey, the reward will be earned and supplied with that box.

9. Statutory cancellation rights

9.1

Your ordinary right to cancel an ongoing subscription under section 8 is separate from any statutory cooling-off rights available to you under UK consumer law.

9.2

Consumers entering qualifying distance contracts may have a statutory right to cancel without giving a reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. For certain contracts involving regular delivery of goods during a defined period, the statutory cancellation period runs for 14 days beginning after receipt of the first goods.

9.3

The precise application of statutory cancellation rights can depend upon the nature and structure of the contract. Nothing in these terms is intended to remove, restrict or replace any statutory cancellation right you have.

9.4

Where you have a statutory right to cancel, you can tell us by making a clear statement that you wish to cancel. You can email:

9.5

You may also use the Model Cancellation Form at the end of these terms where applicable, although you are not required to use that form.

9.6

9.7

Your statutory rights concerning faulty, damaged, incorrect, misdescribed or undelivered goods are separate from your change-of-mind rights.

10. Failed payments

10.1

If a recurring monthly payment fails, our payment provider may automatically retry the payment.

10.2

We may contact you and ask you to update your payment details.

10.3

A failed or unpaid renewal will not be treated as a successfully paid subscription box.

10.4

We will not dispatch a subscription box for a billing period for which the required payment has not been successfully collected.

10.5

While payment remains outstanding, we may:

  • pause the subscription;
  • delay dispatch; and
  • ask you to update your payment method.
10.6

If payment cannot be collected after reasonable attempts, we may cancel the subscription.

10.7

If the subscription is cancelled because payment cannot be collected, we will not require payment for future boxes that have not been supplied.

10.8

If a payment is subsequently recovered, it will count towards a loyalty journey only where the corresponding subscription box is supplied.

11. Changes to prices

11.1

The price payable for your subscription and delivery will be displayed before you subscribe.

11.2

We may occasionally need to change subscription prices or delivery charges because of changes to our costs, suppliers, delivery arrangements or services.

11.3

We will give existing subscribers at least 30 days' notice before a price increase applies to their subscription.

11.4

The notice will explain:

  • the current price;
  • the new price;
  • when the change will take effect; and
  • how to cancel if you do not wish to continue at the new price.
11.5

You may cancel before the new price takes effect.

11.6

We will not use a price-change provision to remove or restrict your statutory rights.

12. If something goes wrong

12.1

Please contact us as soon as reasonably possible if:

  • your box does not arrive;
  • your box arrives damaged;
  • an item is missing;
  • you receive an incorrect item; or
  • a product is faulty.

12.2

Depending upon the circumstances and your statutory rights, an appropriate remedy may include:

  • replacement;
  • repair, where appropriate;
  • refund;
  • price reduction; or
  • another remedy required by law.
12.3

Your statutory rights under the Consumer Rights Act 2015 continue to apply. Nothing in these terms limits those rights.

13. Complaints and Alternative Dispute Resolution

13.1

If you are unhappy with your subscription, order, delivery, payment or our service, please contact us first so that we have an opportunity to resolve the matter.

13.2

We aim to acknowledge customer enquiries and complaints within 48 hours. Where a complaint requires further investigation, we will keep you reasonably informed about its progress.

13.3

Alternative Dispute Resolution, commonly known as ADR, provides mechanisms through which consumers and businesses may attempt to resolve certain disputes without court proceedings. The UK's consumer ADR framework has been updated under the Digital Markets, Competition and Consumers Act 2024.

13.4

Where we are legally or contractually required to participate in an ADR arrangement, we will provide information about the applicable ADR provider and process as required.

13.5

Where applicable, information about approved or accredited consumer ADR providers may be obtained through the relevant UK consumer and ADR authorities.

13.6

Nothing in this section prevents you from:

  • seeking independent consumer advice;
  • exercising your statutory rights; or
  • bringing proceedings before an appropriate court.

14. Changes to UK subscription law

14.1

UK consumer subscription law is changing under the Digital Markets, Competition and Consumers Act 2024. We will review these terms and our subscription processes when the relevant subscription-contract provisions come into force.

14.2

Changes may include requirements relating to:

  • information provided before subscription;
  • renewal and reminder notices;
  • cooling-off rights;
  • online cancellation;
  • ending subscriptions; and
  • other statutory subscription protections.
14.3

We will comply with the legislation applicable to our subscriptions at the relevant time.

14.4

If future legislation gives you greater rights than these terms provide, your applicable statutory rights will take precedence.

15. Our liability

15.1

We are responsible for foreseeable loss or damage you suffer as a result of our breach of these terms or our failure to use reasonable care and skill.

15.2

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability relating to:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; and
  • statutory consumer rights that cannot lawfully be excluded.
15.3

We are not responsible for loss that was not reasonably foreseeable as a consequence of our breach.

15.4

Where an event outside our reasonable control affects our ability to supply your subscription, we will take reasonable steps to minimise the disruption and keep you informed where appropriate. Nothing in this provision removes rights that you have under consumer law.

16. Intellectual property

16.1

Inclusive Stories books, original illustrations, characters, stories, activity materials, branding, logos and other intellectual property are owned by or licensed to Inclusive Stories Ltd or the relevant rights holder.

16.2

Purchasing a subscription does not transfer ownership of those intellectual property rights to you.

16.3

Materials supplied for personal, family or educational use must not be reproduced, resold, distributed or commercially exploited except where:

  • we have given permission;
  • the relevant rights holder has given permission; or
  • the law permits it.

17. Privacy and marketing

17.1

We process personal information in accordance with applicable UK data-protection law, including the UK GDPR and Data Protection Act 2018.

17.2

17.3

Marketing consent is separate from purchasing a subscription. Purchasing, receiving or managing an Inclusive Stories subscription does not itself require you to consent to unrelated marketing communications.

17.4

We may still send service communications necessary to administer your subscription, including information concerning:

  • payments;
  • orders;
  • dispatch;
  • delivery;
  • cancellation;
  • account security; and
  • important changes affecting your subscription.

18. Suspension or refusal of subscriptions

18.1

We may reasonably refuse, pause or cancel an order or subscription where necessary because of:

  • fraud or suspected fraud;
  • payment failure;
  • unlawful use;
  • serious abusive or threatening behaviour;
  • safety concerns;
  • misuse of promotions or our services; or
  • another legitimate reason.
18.2

We will not use this provision to avoid our contractual or statutory obligations.

18.3

Where appropriate, we will tell you why an order or subscription has been suspended or cancelled.

19. General terms

19.1

If a court or other competent authority finds part of these terms unlawful or unenforceable, the remaining provisions will continue to apply where legally possible.

19.2

We may transfer our rights or obligations under the subscription where permitted by law and where doing so does not unfairly reduce your rights.

19.3

You may not transfer your subscription to another person without our agreement unless applicable law gives you the right to do so.

19.4

No delay by us in enforcing a right under these terms means that we have waived that right.

19.5

Nothing in these terms removes or reduces rights that cannot lawfully be excluded under UK consumer law.

20. Governing law and jurisdiction

20.1

These terms are governed by applicable UK consumer law.

20.2

If you live in England or Wales, you may bring legal proceedings in the courts of England and Wales.

20.3

Consumers resident in Scotland or Northern Ireland retain any mandatory rights they have to bring proceedings in the courts applicable to where they live.
